The FDA says it is aware that flavored e-liquids are usually popular with young adults, but that adults also need to be protected against the over-selling of these products by adult consumers. In line with the FDA’s warning letters, a number of the e-liquids involved had no flavor; however, they were being offered accessible in candy bars disguised as a healthy snack.
Cool Cloud Vapor had marketed its e-liquid product as a dietary supplement and a sports drink. These states were misleading, the FDA claims, because no FDA regulatory expectations or laws exist to modify health supplements and sports drinks. The company’s application for a non-prescription market distribution label especially stated that the product could be used as a supplement. It was not intended for use as a sports sip or an athletic supplement, according to the FDA.
